Terms and Conditions
These Terms and Conditions ("Terms") govern the use of mehan.ae ("Platform"). By accessing or using the Platform, you ("User") agree to comply with these Terms. The Platform is operated by [Smart Mehan LLC] ("Company"), incorporated in [United Arab Emirates].
Definitions
- User: Any individual or legal entity that accesses or uses the Platform.
- Freelancer: An individual offering services through the Platform.
- Business: An entity or individual seeking to hire Freelancers.
- Service Agreement: The contractual agreement between a Freelancer and a Business.
Eligibility
Users must be at least 18 years old and legally competent to enter into binding contracts.
Freelancers must have the legal right to offer services within their jurisdiction.
Businesses must have the authority to engage Freelancers.
Account Registration
Users are required to create an account, providing accurate and complete information.
Users are responsible for maintaining the confidentiality of their account credentials and for any activities under their account.
Use of the Platform
The Platform facilitates the connection between Freelancers and Businesses but does not participate in any contractual agreements made between the parties.
Users agree to use the Platform for lawful purposes only.
The Company reserves the right to remove content that violates these Terms or applicable law.
Service Agreements
The Platform is not a party to Service Agreements between Freelancers and Businesses.
Service Agreements must comply with all applicable laws, including those related to employment and freelance work.
Disputes arising under Service Agreements must be resolved by the parties independently.
Fees and Payments
The Platform may charge a fee for facilitating connections between Freelancers and Businesses. The fee structure will be communicated to Users.
Payment processing is handled by third-party payment providers. The Company is not liable for payment disputes.
Confidentiality and Data Protection
Users agree to maintain the confidentiality of any proprietary information received through the Platform.
The Platform's handling of personal data is governed by the Privacy Policy, which is incorporated into these Terms by reference.
Intellectual Property
The Company retains all rights, title, and interest in and to the Platform, including intellectual property rights.
Users may not copy, modify, distribute, or reverse engineer any part of the Platform without the Company's prior written consent.
Limitation of Liability
The Platform is provided on an "as-is" and "as-available" basis. The Company disclaims all warranties, express or implied.
The Company's liability to Users is limited to the maximum extent permitted by law.
Indemnification
Users agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from their use of the Platform or violation of these Terms.
Termination
The Company may suspend or terminate a User's account for any breach of these Terms.
Users may terminate their account by providing written notice to the Company.
Governing Law and Jurisdiction
These Terms are governed by the laws of the United Arab Emirates.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the UAE.
Amendments
The Company reserves the right to amend these Terms at any time. Continued use of the Platform constitutes acceptance of the amended Terms.
